A. Independent Marketplace Relationship
Fello operates solely as a technology and marketplace intermediary.
Fello does not employ Sitters and does not engage Sitters to provide pet-care services on Fello's behalf.
Each Care Agreement is entered into directly between the relevant Owner and Sitter as an independent service relationship.
Subject to the requirements of the relevant Care Agreement, applicable law, animal-welfare requirements and Fello's Platform safety rules, Sitters:
- choose whether to offer services through Fello;
- determine the services they are willing to provide;
- determine their availability;
- determine their advertised prices;
- are free to accept or decline individual Booking Requests;
- are not guaranteed any minimum number of Bookings, hours or earnings;
- are not required to remain available at particular times;
- are free to provide services to persons obtained outside Fello and through competing platforms;
- perform services in their own name and on their own responsibility; and
- exercise their own professional and practical judgment regarding how an accepted service is performed, subject to the Owner's reasonable pet-care instructions.
Fello does not establish working shifts, pay salaries or wages, provide holiday pay, require exclusivity, conduct employee performance management or exercise employer-like disciplinary authority over Sitters.
Fello's establishment of Platform standards concerning safety, animal welfare, eligibility, verification, conduct, service categories and regulatory compliance does not mean that Fello directs or supervises the manner in which a Sitter performs a Care Agreement.
Nothing in these Terms determines a legal classification contrary to mandatory law. Any competent authority remains entitled to determine the legal status of a relationship based upon its actual circumstances.
B. No Agency
A Sitter has no authority to enter into a contract, incur an obligation, make a representation or accept liability on behalf of Fello.
An Owner likewise has no authority to act on behalf of Fello.
Neither party may represent themselves as an employee, agent, representative or partner of Fello.
C. Five-Animal MVP Limit
During the MVP, a Sitter may provide pet-care services through Fello for no more than five animals in total during any calendar day.
The limit applies to animals, not Bookings.
For example, a Booking involving two animals counts as two animals towards the daily limit.
Fello may technically restrict or refuse a Booking that would cause a Sitter to exceed the applicable limit.
A Sitter must not circumvent this restriction by creating multiple accounts or arranging an additional Fello-originated Booking outside the Platform.
Fello may in the future introduce a separate commercial or professional Sitter category permitting services above this threshold. Access to such a category may require evidence of all licences, training, qualifications, insurance or other regulatory requirements applicable to the Sitter.
D. Payments — Fello Does Not Handle Client Money
Unless Fello expressly introduces a separate payment service in the future, payment for a Care Agreement takes place directly between the Owner and the Sitter.
Fello:
- does not receive the service price on behalf of the Sitter;
- does not hold User money;
- does not operate an escrow service;
- does not maintain User balances or wallets;
- does not act as collection agent for the Sitter;
- does not guarantee payment by an Owner; and
- does not guarantee repayment or reimbursement by a Sitter.
During the private beta, care services arranged through Fello are paid for directly in cash by the pet owner to the sitter. Fello does not collect, hold or process these payments.
E. Payment Status in Fello
Sitters may confirm receipt of cash within Fello. Such confirmation is provided by the sitter and is not independently verified by Fello.
A cash receipt confirmation:
- does not constitute a bank statement;
- does not constitute a payment-provider confirmation;
- does not create a payment guarantee by Fello; and
- does not prevent either User from producing evidence that the recorded status is incorrect.
Users must not deliberately submit false payment information.
F. Taxes, Social Security and Business Obligations
Each Sitter is responsible for assessing and satisfying the tax, social-security, accounting, insurance, registration and other legal requirements arising from their independent pet-care activity.
This may include obtaining recognition or registration as self-employed where required.
Fello does not provide tax or social-security advice to Sitters and does not assume their obligations merely because a service was arranged using the Platform.
For a Junior Sitter, responsibilities that legally fall upon a parent or legal representative remain with that person.
G. No Guarantee Created by Platform Controls
Fello may introduce verification, booking limits, profile approvals, ratings, safety rules, account reviews and other Platform controls.
Those measures are intended to improve trust and safety.
They do not constitute a guarantee by Fello:
- that a User will behave appropriately;
- that a User is professionally qualified unless expressly stated;
- that an animal will behave as described;
- that a particular Booking is risk-free;
- that a Care Agreement will be performed satisfactorily;
- that a User is insured; or
- that no loss, injury or damage will occur.
Users remain responsible for assessing whether to enter into each Care Agreement.
H. Owner Responsibility for Pet Information
The Owner is responsible for providing complete, accurate and current information concerning all matters that a reasonable Sitter would need to assess or safely perform the Booking.
This includes any known:
- aggression;
- biting;
- escape behaviour;
- reactivity;
- medical condition;
- medication requirement;
- behavioural trigger;
- dangerous interaction with other animals or people; or
- other material risk.
The Owner is responsible for loss resulting from a material risk that the Owner intentionally or negligently failed to disclose, to the extent permitted by applicable law.
I. User Indemnification
To the extent permitted by applicable law, a User shall indemnify Fello against reasonable third-party claims, losses and costs arising directly from:
- that User's unlawful conduct;
- a material breach of these Terms;
- intentionally or negligently false information supplied by that User;
- infringement of third-party rights by that User; or
- an animal, property or Care Agreement for which that User is legally responsible.
This indemnity does not apply to the extent that the relevant claim was caused by Fello's own conduct for which Fello is legally liable.
J. Platform Liability
Fello remains liable wherever liability cannot lawfully be excluded or restricted.
Subject to mandatory law, Fello is responsible only for direct and reasonably foreseeable loss caused by Fello's own breach of its obligations.
Fello is not responsible for the independent acts or omissions of an Owner or Sitter merely because the parties met or concluded a Care Agreement through Fello.
Fello is not liable merely because it:
- displayed a User profile;
- transmitted a Booking Request;
- performed a verification check;
- displayed availability;
- recorded a User-supplied payment status;
- offered reporting or complaint functionality; or
- enforced Platform safety rules.
Nothing in these Terms excludes or restricts liability where such exclusion or restriction would be invalid under mandatory Swiss law.
K. Cancellation Policy
The Fello Cancellation Policy, as displayed at the time a Booking is confirmed, forms part of the Care Agreement between the Owner and Sitter.
Fello facilitates the recording of cancellations but does not itself become liable for cancellation compensation owed between Users.
Where payment has occurred directly between Users, any payment or repayment resulting from cancellation must likewise be settled directly between the Owner and Sitter unless Fello expressly introduces a different payment service.
